Membership / Card Terms and Conditions

These Terms and Conditions apply to your Membership/ Card and govern the relationship between Abercromby Vending Limited and you.

By using your Membership/ Card you will be deemed to have accepted and be bound by these terms and conditions. They are intended to ensure that the Card system works effectively and conveniently. Please print a copy for your records and take time to read and understand them.

The Membership is issued by Abercromby Vending Limited (Abercromby) whose registered office is at The Cooper Building 505 Great Western Road Glasgow G12 8HN. The Membership will remain the property of Abercromby who reserve the right to cancel its use..

Registering and Topping up your Card

You can register and top up your card online via our website www.abercrombyvending.com. The maximum credit value you can store on your Card at any time is £100 plus any bonus offered by Abercromby.

Using your Card

Your Card can only be used at participating locations to purchase individually priced vending items through Abercromby branded vending machines equipped with card readers. Your Card must be swiped or inserted for all purchases.

It is not a credit card, charge card or debit card and holders must not attempt to use it for any of these purposes. It cannot be used to obtain cash advances or “cashback”.

Expiry

Your Card does not have an expiry date. However, should any credit balance remain 2 years (24 months) following last usage, such credit balances will be lost.

Cancellation and redemption

You have the right to cancel your Membership / Card at any time contacting us in writing to Abercromby Vending Limited 8 Arrol Road Glasgow G40 3DQ.As a Membership / Card holder you are also entitled to redeem at any time any unexpired and unused stored value on your Card provided:

  • the balance on your Card is at least £10;
  • any fees, bonus or discount allocated to the card is redeemed by Abercromby
  • we have no reason to suspect that you are engaged in fraudulent or other criminal activities; and
  • we are not prohibited from redeeming that stored value by any applicable law, regulation, court order
  • or financial authority or instruction or guidance of a competent regulatory authority.

Abercromby will also charge an administration fee of £5.00 for this and reserve the right to vary this charge.

You cannot obtain redemption of any value stored on your Card from Abercromby vending machines or at the premises at which these machines are located.

To enable us to comply with our legal obligations, we may need to carry out checks to verify your identity before processing a redemption request and we reserve the right to refuse to process any redemption request if you fail to assist with that verification process.

Alternatively you can just run down the balance on your Card to £0.00 and contact us for cancellation at the address given above.

Loss, theft, damage

You MUST report the lost card to Abercromby without delay in order that we can block it and prevent fraudulent use.

Abercromby will not be responsible for any losses incurred on lost or stolen cards.

In the event of verified loss, theft, fraud or other unauthorised use of your Card, or if your Card is damaged or malfunctions, once satisfied that the loss is legitimate, we may, at our sole discretion, transfer any credit value stored on it to a replacement card. Circumstances in which we may determine, in our sole discretion, that we will not replace your credit amount include those where we reasonably believe that the notified incident has been caused by your wilful breach of these Terms and Conditions or if there are reasonable grounds for suspecting that you are or have been engaged in fraudulent or other unlawful conduct. Alternatively we may, at our sole discretion, make a redemption payment in respect of any outstanding value stored on your Card.

Complaints procedure

Compensation

Value stored on your Card is not covered by the Financial Services Compensation Scheme. We do not offer any other compensation schemes to cover losses claimed in connection with your Card.

Data protection and privacy
You may be asked to provide personal information, including your name, address and contact details.

We are committed to maintaining the security of your personal information in accordance with the requirements of the Data Protection Act and will take all reasonable steps to ensure that your personal data is kept secure against unauthorised access, loss, disclosure or destruction.

Except as required by law, or in accordance with these Terms and Conditions, your personal information will not be passed to any other persons without your permission.

Liability of Abercromby

Abercromby shall not be held liable for any default resulting directly or indirectly from inability to accept card payments due to technical problems including, but not limited to, machine breakdown, failure of network services and failure of data processing systems. Abercromby shall not be held responsible, or deemed to be in breach of service, by being unable to provide any specific vending product or products due to any cause, nor for any services due to force majeure or any other cause beyond Abercromby’s control. To the extent permitted by law, all conditions or warranties implied by law, statue or otherwise are expressly excluded.

Variation

We reserve the right to amend or waive any provision of these Terms and Conditions from time to time and at any time, or to terminate the Membership / Card programme on reasonable notice. The Terms and Conditions applicable to the use of Vendfirend Membership / Card shall at any time be the terms and conditions published at www.abercrombyvending.com and your continued use of the Membership/ Card shall constitute your acceptance of such terms and conditions.

Governing law

These Terms and Conditions shall be governed by the law of Scotland and the parties submit to the exclusive jurisdiction of the court of Scotland. Your use of this website and any dispute arising out of such use of the website is also subject to the laws and jurisdiction of Scotland.
